Rights of way, easements and covenants
Others may have rights over your land, and you may be bound by promises made by past owners.
Easements include rights of way, drainage and access for repairs. They pass with the land and can stop you building over a route.
Restrictive covenants (for example 'no more than one house') can bind you even if they're old. Sometimes indemnity insurance or an application to the Upper Tribunal can help.
What to check
- What does the title say?
- Is anything you plan to do blocked by a covenant?
- Is indemnity insurance offered, and what does it really cover?
Who can help
Your solicitor.
