Ground rent, service charges and major works
What leaseholders pay, how to challenge it, and the consultation rules for big bills.
Service charges must be reasonable and for work done to a reasonable standard. You can ask for a summary of costs and inspect the receipts.
Before major works that would cost any one leaseholder more than £250 (or long-term contracts over £100 a year per leaseholder), the landlord must consult leaseholders under Section 20 of the Landlord and Tenant Act 1985. If they don't, the amount they can recover may be capped.
Disputes about service charges can go to the First-tier Tribunal (Property Chamber).
Leaseholders can also take over management through the Right to Manage without buying the freehold.
What to check
- Last three years of service charge accounts
- Reserve fund balance
- Any Section 20 notices for planned works
Who can help
The Lease Advisory Service (free), then a solicitor or the tribunal.
